Motorcycle Accidents

If a driver of a motor vehicle fails to use reasonable care and a result of that failure, the driver or passenger on a motorcycle is injured, then the driver of the motor vehicle is liable for those injuries.

The failure to wear a motorcycle helmet in Ontario is treated in the same manner as a failure to wear seatbelts in an automobile. Such a failure (in the case of a head injury) could limit or reduce the final award of damages. However, this does not mean that you do not have a claim.
