Long-Term Disability Versus Short-Term Disability: Know the Difference

We advise our clients to be aware of the sort of disability coverage they need, and by extension which sort of payments and/or damages we will pursue.

Short-Term Disability

The Financial Consumer Agency of Canada reports that short-term disability payments typically cover a six-month period and are usually given to those facing a short-term injury or illness. These plans are typically provided by an employer, and if your employer has denied short-term disability coverage, we can analyze your situation and advise you on the best course of action.

Despite the shorter-term payout, these payments can be just as critical to their recipients as long-term disability, and going without them is out of the question for most. If you have been denied short-term disability, we can help you take the next steps in pursuing the compensation you need.

Long-Term Disability

Long-term disability insurance, whether you receive it through your employer or the public assistance network, covers a period greater than six months and generally kick in when you have exhausted:

  • Any short-term disability coverage
  • Sick leave benefits from your employer
  • Employment Insurance (EI) sick leave benefits

Insurance companies may be even more reticent to pay out long-term disability payments than short-term disability benefits. If you are experiencing pushback from an insurance company, we may be able to help you secure the long-term disability compensation that you need.

You May Be Eligible for Benefits Under the Canada Pension Plan (CPP)

We regularly try claims for clients who are owed benefits from the Canada Pension Plan (CPP). Under this plan, Canadians aged 65 and older are eligible for a disability benefit, a post-retirement disability benefit, or some combination of both.

The average amount paid out to CPP recipients in July 2019 for their post-retirement disability was about $496, a figure which also represented the maximum payout. CPP recipients received an average payout of approximately $988 under the disability benefit, with a maximum payout of $1,362.

If you are a Canadian aged 65 or older, we may be able to secure further benefits under the auspices of the Canada Pension Plan. Call us today to find out if you are eligible for compensation from the CPP.

Disability Insurance is Often Insufficient

We review disability insurance policies on a daily basis, and we typically see that these policies do not pay what our clients need to pay their bills. Those who rely on long-term disability payments may be especially vulnerable, as most who receive them rely on them as a primary source of financial support.

Yet, long-term disability coverage typically compensates recipients for only 60% to 70% of your normal income. Employment and Social Development Canada (ESDC) reports that the qualification for receiving disability benefits is a “severe”, “prolonged” disability that prevents you from being able to work any job on a regular basis. Yet, we see time and again that clients who meet this threshold are denied the benefits they deserve.

The courts are designed to ensure that you are not left without the disability benefits you deserve, and a disability lawyer serving Brockville can assist you through the legal process.

How We Can Help You

If you are having trouble securing disability compensation or your payments were suddenly reduced or stopped, know that you likely face a mountain of red tape before having those payments restored. We have experience cutting through this red tape efficiently, and we will ensure that your case is heard sooner than later.

We assist our clients in several ways, including:

  • Obtaining, analyzing, and documenting medical records as proof of disability
  • Speaking with your attending medical professionals to gain a full picture of your injuries and their impact on your ability to maintain steady employment
  • Filing a claim with your insurer to obtain, resume, or increase disability payments
  • Filing and seeing through any legal action required to pursue the damages you deserve and require

This is just the overview of what we will do for you as a client and does not include the litany of legal and medical correspondence, document completion and filing, and related hurdles that come with successfully pursuing disability compensation.

We Assist Disabled Veterans

One of the groups most in need of disability payments is Canada’s active and retired veterans of the armed forces. These heroes put their lives on the line, yet often face unwarranted pushback when it comes time to collect financial compensation for their injuries.

We are proud to represent:

  • Members and retirees of the Canadian Armed Forces
  • Current and former members of the Royal Canadian Mounted Police (RCMP)
  • Veterans of the Second World War and Korean War, including members of the Merchant Navy

Veterans Affairs Canada affirms that members of each of these groups who have been diagnosed with a medical condition or disability and are able to show that these conditions are related to their service are entitled to disability benefits. They may be eligible to receive:

  • Pain and suffering compensation, to be paid throughout their life in monthly installments or as a lump sum
  • Disability pension, to be paid throughout their life in monthly installments

You are entitled to these payments, but as many veterans know, receiving them is not as straightforward as it should be. If you are a disabled veteran or current member of the armed forces, a disability lawyer serving Brockville can help you file a claim to obtain the level of compensation that you are entitled to.
