In Ontario, people who have been injured in motor vehicle accidents are entitled to receive no-fault accident benefits from their auto insurance provider.
Apart from the obvious physical challenges that catastrophically impaired car accident survivors are required to face each day, many permanently injured accident victims experience psychological trauma, emotional distress, and financial strain. Some of the financial burdens survivors often have to bear include medical expenses, physical rehabilitation, home modifications, lost wages, future earnings, and the costs of attendant care.
That is why anyone in the province who has been injured in a motor vehicle collision should be entitled to accident benefits. Per the Ontario Statutory Accident Benefits Schedule (SABS), the following no-fault accident benefits must be included in all basic auto insurance plans:
- $3,500 in medical and rehabilitation benefits for accident victims who sustained minor injuries
- $65,000 over 5 years for the combined total costs of medical, rehabilitation, and attendant care benefits for accident victims who sustained non-minor, non-catastrophic injuries
- $1 million for life in combined medical, rehabilitation, and attendant care benefits for accident victims who sustained catastrophic injuries
Accident benefits are meant to help cover the costs of injured survivors of motor vehicle collisions. Eligible recipients could include injured drivers, passengers, cyclists, pedestrians, and motorcyclists involved in motor vehicle collisions.
Owing to the ongoing, pervasive costs associated with severe, permanent injuries, catastrophically impaired motor vehicle accident survivors should be eligible for substantially higher amounts of accident benefits than those with minor or non-catastrophic injuries. Injured accident survivors should be entitled to these higher benefit amounts if their collision resulted in at least one of the following outcomes:
- Paraplegia or Tetraplegia
- Severe impairment of ambulatory mobility or use of an arm, or Amputation
- Loss of Vision of Both Eyes
- Traumatic Brain Injury (TBI) meeting the Glasgow Outcome Scale-Extended (GOS-E) criteria
- Physical Impairment or Combination of Physical Impairments (which results in 55% or more of the whole person)
- Mental or Behavioural Impairment (excluding Traumatic Brain Injury) Combined with a Physical Impairment (which results in 55% or more impairment of the whole person)
- Marked impairment in three or more areas of function that precludes useful functioning; or an Extreme impairment in one or more areas of functioning due to a mental or behavioural disorder
