Individuals purchase Long-Term disability insurance, either privately or through their employer, just in case they should ever get into an accident that leaves them unable to work and earn an income. Like with other insurance policies, policyholders pay a certain amount every month to keep their policy valid and active. Some never have to use the insurance, but others are not so lucky.
And to make matters worse, when the unfortunate happens and it is time to claim those benefits, insurance companies often do not want to pay. When this is the case, it is important that those injured or ill speak to a Toronto Long-Term disability lawyer to discuss recovering compensation and the steps an our Toronto Long-Term disability lawyers can take to help you.
Common Issues With Long-Term Disability Claims
Insurance companies are in the business of making money and giving that money back to their investors, not actually paying out benefits to their policyholders.
As a Toronto Long-Term disability lawyer can tell their client, when insurance companies create their policies, they are often filled with complicated language that is vague, elusive, and difficult to understand. This is done purposely, as insurance companies can use this to their advantage, rejecting even legitimate claims for just about any reason they choose. Often, policyholders have to take the insurance company at their word, simply because they themselves do not understand the policy terms.
When insurance companies do pay out benefits, they may use this same confusing language to lead policyholders to believe they are not entitled to as many benefits as they thought. This can lead to reduced or partial payments, which may not be enough to cover the expenses of the disabled person.
In other cases, the insurance company may say they are willing to pay, but the benefits are severely delayed — sometimes by months. This can also seriously affect the disabled person, as they are left with little to no resources during that time.

How A Toronto Long-Term Disability Lawyer Might Be Able To Help
Sadly, many people may hinder their Long-Term disability case before it has even really started, and this can occur in a number of ways. One of the most common is when insurance companies tell a policyholder that they must take a medical exam with one of the insurance company’s independent doctors or medical experts.
These health professionals are not always as independent or unbiased as they may seem, and they can severely hurt a disability case by reporting that the individual is not quite as injured or sick as they are saying.
This stall tactic is just one reason why it is so important that individuals contact a Long-Term disability lawyer in Toronto. A lawyer can help break down insurance policies, and they can also help deal with the insurance companies so that individuals receive the full benefits they are entitled to. A lawyer can also help individuals who have been denied benefits, making sure that they have their benefits reinstated.
If you or a loved one has suffered a Long-Term disability, do not wait another minute to contact a Toronto Long-Term disability lawyer who knows how to deal with insurance companies and how to get you the benefits you deserve. Contact Preszler Injury Lawyers today.

long-term disability FAQs
Here are some commonly asked questions for long-term disability claims
How long will it take to settle my case?
The duration of a long-term disability case can vary depending on a number of factors, including the reasons provided for the claim’s denial, the policyholder’s standing with their insurance provider, the complexity of the claimant’s case, the willingness of the insurance company to negotiate, Court availability, and other considerations. Generally speaking, it can take between 1-3 years for a fair resolution to be reached.
How much will I pay in lawyers’ fees?
Our long-term disability lawyers work on a contingency fee basis. That means we only get paid if the case is won, and our fees are based on a percentage of the compensation awarded. You will not be required to pay any upfront fees out-of-pocket in order to pursue legal action.
How long do I have to sue?
The statute of limitations for a long-term disability lawsuit in Ontario is generally two years from the date of the denial of benefits or the last payment of benefits. However, depending on the circumstances of the case, the lawsuit could be subject to additional time limitations. It is crucial to speak with a long-term disability lawyer as soon as possible, so as to not jeopardize your chances of recovering the compensation you deserve.
Do I have a strong case?
The answer to this question depends on the facts of your individual case. Our Ontario long-term disability lawyers should be able to evaluate the terms of your policy, review the evidence available to you, and consult with medical experts to assess the strength of your claim.
How much compensation will I get?
It is almost impossible to predict the specific amount of compensation you might be entitled to, however after reviewing the details of your case, our Ontario long-term disability lawyers may be able to provide you with an estimate that you could reasonably expect to be offered. The decision to accept settlement offers is yours and yours alone.
Do you represent insurance companies?
No, our long-term disability lawyers are solely committed to protecting the rights of policyholders who have been unfairly treated by insurance providers.
Will the insurance company continue to pay my disability benefits after we settle the case?
The answer to this question depends on the terms of your individual settlement. In most cases, the settlement will include a lump sum payment for past and future benefits. After agreeing to these terms and accepting this settlement offer, future benefits will no longer be paid. However, in some scenarios, insurance companies may only offer to settle for past benefits owing and might agree to continue paying benefits after the case is settled until the terms of the policy are reached.
Should I speak to the adjuster on my file after my benefits have been terminated?
It is not recommended that you speak to the adjuster on your file after your benefits have been terminated. Anything you say could be used against you. That is why it is best to consult with our long-term disability lawyers before communicating with your insurance company.
