There are three kinds of Schedule B benefits. The first is income replacement. Generally speaking, you are covered for up to 80% of your typical income, up to a maximum of $600 per week, if you cannot work after an accident. If you are not working at the time of the accident, you can still receive some income replacement, as long as you are incapacitated. In that case, you are eligible for up to $200 per week. Income replacement benefits are available for two years after an accident, so it is not a long-term benefit, but it is an important benefit that provides protection for the first two years.
The second kind of Schedule B benefits is medical benefits. These include physiotherapy, chiropractic care, massage therapy, occupational therapy, and counseling. You have access to up to $50,000 in medical treatment for the first two years after an accident.
The last kind of Schedule B benefit is a death benefit. If someone passes away in an accident, there are set amounts, usually between $3,000 and $10,000 per family member, paid out to the surviving family members, as well as amounts for funeral costs and grief counseling.
In order to get Schedule B benefits, you need to fill out an AB1 form. You also need an accident report from the police. You take those forms and send them to your insurance company. Make sure you do so on time, and that is how you generally access Schedule B benefits.
It is also important that you see your healthcare provider. You want to report your injuries and determine what treatment you need to recover. Your healthcare provider will be an important part of your Schedule B claim because they will help inform the insurance company about the treatment you need to get better.
Lawyers assist with Schedule B benefits by filling out the necessary forms, ensuring you do not miss filing deadlines, and working with or against the insurance company to make sure that all of your expenses are paid. Something I can tell you is that all of my clients prioritize their health over any legal case or settlement. This is why Schedule B benefits are so important; these benefits are designed to help you recover after an accident so that your legal claim becomes less critical. Again, the first goal is always recovery.
If your benefits are denied, which is unfortunately not uncommon, your lawyer will also fight to ensure you receive the treatment you need, giving you the best chance at recovery. For more information on Schedule B benefits, call Preszler Injury Lawyers at 1-800-JUSTICE.
