Traffic laws exist in an attempt to reduce the instances of fatal and injurious accidents on the province’s roads and highways. Unfortunately, according to a recent report on traffic safety statistics released by the Ontario Ministry of Transportation, nearly 24,000 deadly or injury-causing car accidents occurred throughout the province in just one year

In accordance with the province’s Highway Traffic Act, anyone who operates a motor vehicle in Ontario is legally required to fulfill a duty of care to other road users, including:

  • Other drivers
  • Their passengers
  • Motorcycle riders
  • Cyclists
  • Pedestrians
  • And others

If a driver violates any of the rules of the road and their wrongful conduct causes a collision in which another road user sustains compensable injuries, the at-fault motorist might be considered negligent and, as a result, they might be liable for damages incurred by injured accident victims. Depending on the severity of the injuries sustained and the impact they have had on a car accident victim’s overall quality of life, these damages often include:

  • Medical expenses
  • Pain and suffering
  • Attendant care
  • Physiotherapy
  • Mobility aids, assistive medical equipment
  • Prescriptions
  • Home modifications to accommodate newly acquired disabilities
  • Ambulance services
  • Mileage expenses to and from medical appointments
  • Housekeeping services
  • Psychological counseling
  • And possibly more

If you were injured in an accident caused by a negligent driver, there is no time to waste. In accordance with the Ontario Limitations Act, injured car accident victims have only two years from the date of their collisions in which to pursue a civil claim. That is why it is so important to schedule a free initial consultation with our car accident lawyers serving Smiths Falls as soon as possible.

Even the most safety-minded, cautious, and attentive motorist can be injured in a car accident caused by a negligent driver. If someone fails to consider the devastating potential consequences of their actions, unsuspecting, innocent motorists can be severely injured, or even killed.

Because of a driver’ lack of concern for the safety of others, families can be torn apart. In a sudden, violent, and tragically preventable set of circumstances, community members going about their daily routines can have their lives cut short, and all because of another driver’s disregard for their physical safety.

By working with our Smiths Falls car accident lawyers, injured car accident survivors may be able to recover both economic and non-economic damages resulting from their injuries from the irresponsible drivers whose negligence caused their injurious accidents to occur.  To get started, call 1-800-JUSTICE and receive a free initial consultation with our car accident lawyers serving Smiths Falls.

car accident FAQs

Here are some commonly asked questions for car accident claims

Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.

If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.

Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.

The amount of income replacement benefits you can receive will depend on your pre-accident income, but typically these benefits can cover up to 70% of your gross income before the accident, up to a maximum of $400 per week. If you pursue a civil claim against the at-fault driver whose negligence caused your collision, you may be able to recover 100% of your gross income loss and earning capacity after the trial.
