Anyone injured in an accident involving a motor vehicle has access to these accident benefits through a motor vehicle insurance policy. The term "motor vehicle" is often debated and includes cars, motorcycles, trucks, snowmobiles, ATVs, and, in certain circumstances, buses.
Individuals injured in an accident can access these benefits, but there is a specific framework for how a person can gain access. Additionally, there is a specific schedule that dictates which insurance policy to apply to. For instance, injuries involving pedestrians or passengers of a vehicle may not have their own insurance policy, so the law establishes a priority for how a victim of an accident can access accident benefits.
There is also a specific timeline that must be followed to access these benefits. Firstly, you must notify the insurance company of your intention to apply within seven days following an accident. After that, you have 30 days to file the formal application for accident benefits with the insurance company. Generally, you have 30 days from the date you receive the application. Attendant care is a form of treatment that can be provided by a personal support worker, a nurse, or, in some cases, family members. This care is often necessary following surgeries or due to serious impairments, where you require assistance with various aspects of your activities of daily living, such as bathing, grooming, laundering, and transferring. Under the standard policy of $65,000, the maximum you can receive for attendant care is $3,000 per month. If you are catastrophically impaired, you can receive up to $6,000 per month.
