Robert Malen

Robert Malen is a seasoned commercial litigator with more than four decades of experience representing individuals and businesses in complex disputes.

Robert earned a Bachelor of Arts (First Class Honours) from McGill University, and his LL.B from the University of Toronto Faculty of Law.  He was called to the Bar of Ontario in 1979.

Robert’s practice is devoted to the resolution of corporate and commercial, shareholder, banking, real estate, construction, employment, estates and trust disputes through litigation, mediation and strategic negotiation. He represents both individuals and corporations.  A skilled advocate, negotiator and strategic thinker, Robert is highly respected by clients, the courts and opposing lawyers for his practical approach and effective advocacy. Robert’s principal areas of practice include: corporate and commercial litigation, employment, shareholder disputes, construction law, real estate and leasing, and estates and trusts.

Robert has successfully represented clients at every level of court in Ontario, as well as before the Supreme Court of Canada. He has acted as trial counsel in numerous cases and has appeared as appellate counsel before the Ontario Divisional Court, the Court of Appeal for Ontario and the Supreme Court of Canada.

Robert is also a recognized author and editor. In April 2021, Thomson Reuters published the second edition of “Distress: A Commercial Landlord’s Remedy,” which he co-edited. In October 2023, Thomson Reuters published the second edition of  “Assignment, Subletting and Change of Control in a Commercial Lease,” which he also co-edited.

Robert co-authored the chapter on “Costs” in Civil Procedure and Practice in Ontario 2021, published by Canlii.  He has also written several articles published in the Advocates Quarterly.

Robert has many reported decisions,  including cases published in the Ontario Reports, Dominion Law Reports, Business Law Reports, and Real Property Reports.

For four years, Robert taught a weekly law course for business students at the University of Toronto.

Robert has been recognized in the 2025 edition of Best Lawyers in Canada.
