Commercial motor vehicles like trucks can weigh more than 60,000 kg. These large, heavy trucks travel at high speeds on provincial roads and highways, delivering goods, materials, and supplies to communities throughout Ontario. However, if large commercial trucks are involved in a collision, the results can be catastrophic.

Owing to their heavy weight, when fast-moving trucks collide with smaller passenger vehicles, occupants of the smaller vehicle could easily lose their lives. If they are fortunate enough to live through the harrowing experience, truck accident victims often sustain debilitating, catastrophic injuries.

According to the Ontario Provincial Police (OPP), fatal collisions caused by heavy commercial trucks are soaring to an all-time high. In less than a year, there have been more than 4000 collisions involving commercial motor vehicles, accounting for more than 20% of traffic fatalities in the province. That marks a 40% year-over-year increase in serious truck accidents.

Many of these serious truck accidents are caused by their operators’ negligence behind the wheel. Leading causes of deadly or injury-causing truck accidents include following too closely, improperly changing lanes, speeding, and driver inattention.

All drivers throughout the province– including truck drivers– are required to abide by the rules outlined in the Ontario Highway Traffic Act. Anyone who operates a motor vehicle has a legal obligation to do so in a reasonably cautious manner, and in consideration of the safety of all other road users. If a truck driver fails to uphold the duty of care they owe to others by engaging in unsafe conduct on the road, they could be considered negligent. As such, they could be liable for damages incurred by injured survivors of collisions caused by the wrongful behaviour, as well as damages incurred by the family members of wrongful deceased fatal truck accident victims.

However, truck accident claims are unique in that there may be more than one negligent party or entity responsible for compensating accident victims. If a negligent truck driver’s employer was aware that they had a history of irresponsible conduct on the road, for example, but they continued to send them out on deliveries, thereby knowingly putting other road users in harm’s way, they might be considered to be contributorily negligent. Therefore, they might also be liable for damages incurred by people who have been injured as a result of their employee’s wrongful actions on the road.

In the aftermath of a serious, injury-causing truck accident, it can be difficult to know where to turn for accountability and how to go about recovering the maximum amount of compensation to which you might be entitled. Our Scarborough truck accident lawyers have experience helping injured members of the local community and the families of deceased truck accident victims get the compensation they deserve.
