Anytime you are the operator of a motorcycle and you get into a collision, there is a high probability that you will sustain very serious injuries. The reasons for this are similar to those for any other off-terrain vehicle: there are no restraints, high speeds, and limited protection compared to a car or truck. When you are ejected from the bike, or if you enter into a speed wobble and get thrown off, or if you get struck, there is nothing protecting you from high-speed vehicles, the ground, or stationary objects.
At my firm, we see the results of motorcycle collisions, and these collisions are some of the absolute worst. The level and severity of the impairment are often second to none. We frequently see loss of limbs, very serious brain injuries, and severe fractures that result in multiple surgeries. We also see a lot of head injuries, which all go back to having limited physical protection surrounding your vehicle. Another contributing factor is often high speed. Even if you are wearing a helmet, it does not guarantee that you will walk away without issues.
Now, accident victims involved in motorcycle collisions, and for the purpose of this discussion, I am assuming they are not at fault for the accident, have a first avenue of recourse through the accident benefit system. The accident benefit system outlines a variety of benefits that you can access through your motorcycle insurance policy. If you are working, this policy can provide you with an income replacement benefit of up to $400 per week. If you are not working, you may qualify for a non-earner benefit of up to $185 a week. There are specific periods during which these benefits will last, and each benefit is different.
In terms of medical treatment, there are technically three different stages of coverage you can have. The first is for minor injuries, which covers just soft tissue injuries with no barriers to recovery, and that will cover you up to $3,500. The second tier, which most people involved in motorcycle collisions qualify for, is up to $65,000 for medical and rehabilitation coverage, along with attendant care. The third level is for catastrophic impairment, which is a defined term that applies to those who are the most seriously impaired.
The second option you have is to file a lawsuit. This is where you sue the at-fault driver or the owner and driver of the vehicle that caused the collision, whether it is the left-turn operator, someone making an unsafe lane change, or if you are a passenger on a motorcycle and the driver makes an error. You have recourse, and that recourse allows you to sue for pain and suffering, past loss of income, future loss of income, and all future medical needs that may arise as a consequence of the accident.
