From rush-hour traffic along Yonge Street and Wellington Street East to busy commutes on Highway 404 and regional roads connecting Aurora to Newmarket and Richmond Hill, collisions can happen in seconds. Even a seemingly “minor” crash at a local intersection can lead to serious injuries, lost income, and long-term pain.

If you were injured in a motor vehicle accident in or near Aurora, you may be entitled to accident benefits through Ontario’s Statutory Accident Benefits Schedule (SABS) and may also have the right to sue an at-fault driver in certain circumstances.

Our Aurora car accident lawyers can review your situation, explain your options, and help you pursue the compensation you may be entitled to. Contact us today to discuss your situation and your potential legal rights.

Accident Benefits And Lawsuits After An Aurora Collision

In Ontario, people injured in car accidents typically have two main paths to financial recovery.

Statutory Accident Benefits

First, accident benefits are generally available through your own automobile insurer (or another insurer if you do not have your own policy). These benefits may help with income replacement, medical and rehabilitation costs, attendant care, and certain other expenses, even if you were partly at fault.

Accident Benefits are available through Ontario’s Statutory Accident Benefits Schedule. They can be claimed by any individual hurt in a car accident or other motor vehicle accident, even if they were partially or fully at fault for the crash.

Car Accident Lawsuits (Tort Claims)

In some cases, you may be able to sue a negligent driver for additional damages, such as pain and suffering, loss of future income, and future care costs. These tort claims are subject to special thresholds and deductibles set out in Ontario’s Insurance Act and related regulations. They are meant to compensate you for damages that you were not able to recover through Statutory Accident Benefits.

The interaction between accident benefits and tort claims can be complicated. Our Aurora car accident lawyers can help you understand which benefits you may qualify for, how to complete forms properly, and whether a lawsuit may be appropriate in your circumstances.

If your injuries are severe or permanent, we may also involve our Aurora catastrophic injury lawyers to explore whether your condition qualifies as a catastrophic impairment under the SABS, which can significantly increase available benefits.

Common Car Accident Injuries And Long-Term Effects in Aurora

Collisions in and around Aurora can cause a wide range of injuries. Some people experience relatively short-term soft tissue injuries, while others face serious, life-altering trauma. Common injuries include whiplash, neck and back strains, fractures, joint injuries, concussions and other brain injuries, and psychological conditions such as anxiety, depression, and post-traumatic stress disorder.

These injuries can affect every part of your life. You may find it difficult to sit, stand, or walk for long periods, to drive yourself or your children, or to return to your job in the same capacity. Some people need ongoing physiotherapy, chiropractic treatment, massage therapy, counselling, or medication, sometimes for years.

If your injuries prevent you from returning to work, it may be important to speak not only with a car accident lawyer but also with an Aurora long-term disability lawyer about LTD claims that might arise from the same collision.

The Financial And Emotional Impact Of Aurora Car Accidents

Beyond the immediate physical injuries, car accidents often have serious financial and emotional consequences for individuals and families. You may face reduced income, unexpected medical and rehabilitation expenses, childcare challenges, transportation difficulties, and the stress of dealing with multiple insurance companies.

Emotionally, many people experience fear of driving, sleep disturbances, irritability, or a general feeling that life is no longer under control. These effects are real and can be just as disabling as physical injuries.

Our Aurora car accident lawyers take these realities into account when assessing your claim. We look at your past and future income loss, out-of-pocket expenses, and future care needs, as well as your pain and suffering, to help ensure any compensation pursued reflects the full scope of your losses.

What To Do After A Car Accident In Aurora

If you are involved in a collision in Aurora or the nearby York Region, you should:

  • Ensure everyone’s safety and call 911 in emergencies.
  • Seek medical attention, even if you feel “okay” at first.
  • Exchange information with other drivers and witnesses.
  • Report the collision to police or a Collision Reporting Centre if required.
  • Notify your insurer promptly and ask about accident benefits forms.
  • Keep all records and receipts related to the accident.

Before giving detailed statements to any insurance company, consider speaking with an Aurora car accident lawyer. A short conversation can help you avoid missteps and better understand your next steps. Settling early on in the process may bar you from pursuing the full amount of compensation you might be entitled to in the future.

car accident FAQs

Here are some commonly asked questions for car accident claims

Yes. Even when fault seems obvious, insurers often argue about liability or damages. A lawyer ensures your rights are protected.

Ontario uses a system called contributory negligence. If you share blame, your damages may be reduced by your percentage of fault.

Preszler Injury Lawyers works on a contingency fee basis. You don’t pay upfront legal fees. Instead, payment is based on the outcome of your claim.

The Motor Vehicle Accident Claims Fund provides a safety net in these situations. Our team can help you pursue this option.

Yes. Passengers have the same rights to accident benefits as drivers. You may also pursue a tort claim against the responsible driver.

Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.

If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.

Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.
