When drivers behave irresponsibly on the road, the consequences can be deadly. If a driver engages in negligent conduct, even for the briefest of moments, innocent bystanders, pedestrians, cyclicts, vehicle operators and passengers, and other road users can lose their lives in senseless, violent, preventable car accidents.Â

In the few seconds it takes to glance away from the road to check a text message alert on your cell phone, children can be orphaned, families can be torn apart, and people going about their daily business could sustain injuries from which they never recover. The selfishness and carelessness of negligent drivers can have far-reaching, all-encompassing implications for the injured victims of car accidents.Â
Cell phone use behind the wheel has become increasingly common, despite the government’s best efforts to educate both new and seasoned drivers about its fatal potential. In fact, most deadly car accidents in the province are caused by distracted driving.Distracted driving has overtaken impaired/inebriated driving as the leading cause of fatalities on Ontario’s roads and highways. Sadly, given the fact that almost half of all Canadians have admitted to using their mobile devices behind the wheel of their vehicles, it should come as no surprise that the fatal impact of distracted driving has become so widespread.Â
Any driver who violates local traffic laws essentially fails to fulfill the duty of care they are legally required to provide other road users in accordance with the provincial Highway Traffic Act. Distracted driving might be the leading cause of fatal accidents in Ontario, but any infraction that leads to a car accident could be considered negligence. Common examples of driver negligence that often lead to injury-causing or fatal car accidents in Whitby include:
- Texting while driving
- Driving under the influence of alcohol and/or drugs
- Speeding
- Reckless driving
- Improperly changing lanes
- Ignoring traffic signs/signals
- Fatigued drivingÂ
- And more
The negligence of other drivers can cause fatal car accidents. They can also lead to collisions in which law-abiding road users sustain a number of injuries. Regardless of whether a car accident victim has sustained catastrophic injuries or more moderate ones, they could experience prolonged periods of physical pain and discomfort, develop severe mental health issues, and incur substantial monetary losses.Â
No one should be forced to pay the price of someone else’s wrongful conduct. That is why, if you were injured in a motor vehicle collision because of someone else’s negligence, our Whitby car accident lawyers may be able to assist you.

car accident FAQs
Here are some commonly asked questions for car accident claims
How soon after an accident can I start receiving loss of income benefits?
Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.
What happens if my injuries meet the threshold of catastrophic impairment?
If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.
Do my family members have the right to sue the at-fault driver?
Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.
How much money can I receive to cover lost wages before and after trial?
The amount of income replacement benefits you can receive will depend on your pre-accident income, but typically these benefits can cover up to 70% of your gross income before the accident, up to a maximum of $400 per week. If you pursue a civil claim against the at-fault driver whose negligence caused your collision, you may be able to recover 100% of your gross income loss and earning capacity after the trial.
