The consequences of someone else’s wrongful actions can be life-changing. Because of another driver’s negligence, an injured car accident victim could find themselves facing an uphill battle physically, emotionally, and financially every day for the rest of their lives.
When negligent motorists behave in a wrongful manner behind the wheel, they put the lives of other road users at risk. Those who are fortunate enough to survive a traumatic accident caused by a negligent driver often sustain a number of physical injuries, ranging in severity from moderate to catastrophic. The injuries sustained in a car crash often result in massive financial losses for the accident victim and their families.
In addition to the physical and economic challenges often experienced by seriously injured car accident survivors, many accident victims who have sustained substantial physical injuries also develop significant mental health issues. Often debilitating in nature, these secondary disabilities can profoundly affect an injured accident victim’s overall quality of life. This is especially true for the survivors of motor vehicle collisions who are no longer able to work because of the psychological after-effects of their accidents. These often include:
- Depression
- Anxiety
- Post-traumatic stress disorder (PTSD)
- Insomnia or other sleep disorders
- Alcohol use disorder
- And more
In the province of Ontario, anyone who owns or operates a motor vehicle is required to hold mandatory automobile insurance. All automobile insurance policies throughout the province are required to provide coverage in accordance with the Statutory Accident Benefits Schedule. As such, any motorist who is injured as a result of a collision should be able to collect no-fault accident benefits. This insurance coverage is available to all injured survivors of car accidents throughout the province, regardless of which driver was responsible for causing the collision.
That means that, even if your own wrongful actions behind the wheel contributed to the conditions that led to your accident, you may still be eligible to receive financial support. Statutory accident benefits are intended to offset the cost of certain injury-related expenses, often including:
- Medical expenses
- Ambulance bills
- Medical equipment
- Prescriptions
- Mobility aids
- Physiotherapy
- Chiropractic sessions
- Massage therapy
- Strength-training exercise programs
- Psychological counseling
- Home modifications to accommodate acquired disabilities
- Mileage expenses for trips to and from medical appointments
- And possibly more
However, depending on the severity of the injuries you have sustained, the insurance coverage available to you may not sufficiently cover your total financial losses. The economic impact of sustaining injuries in a car accident can be substantial.
Most drivers do not anticipate being involved in a serious, life-altering collision. As such, few people are prepared for the overwhelming financial repercussions following a severe, injurious car accident.
However, if you have been injured in a motor vehicle collision caused by another driver’s wrongful actions, our Rainy River car accident lawyers may be able to help you recover the compensation you deserve. By pursuing legal action against the negligent driver responsible for causing your collision, our car accident lawyers serving Rainy River may be able to help you recover the financial losses you have incurred as a result of your injuries.

car accident FAQs
Here are some commonly asked questions for car accident claims
How soon after an accident can I start receiving loss of income benefits?
Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.
What happens if my injuries meet the threshold of catastrophic impairment?
If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.
Do my family members have the right to sue the at-fault driver?
Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.
How much money can I receive to cover lost wages before and after trial?
The amount of income replacement benefits you can receive will depend on your pre-accident income, but typically these benefits can cover up to 70% of your gross income before the accident, up to a maximum of $400 per week. If you pursue a civil claim against the at-fault driver whose negligence caused your collision, you may be able to recover 100% of your gross income loss and earning capacity after the trial.
