No one anticipates that, one day, their routine drive to work, to the grocery store, to school, or any other location they regularly visit will end in tragedy. Unfortunately, fatal car accidents in Ontario are all-too common. In fact, according to the OPP, in recent years, deaths from automobile collisions reached a historic provincial high.

Even the most safety-minded motorist can be involved in a collision when they encounter a negligent driver on the road or highway. Because of a complete stranger’s failure to consider the potentially fatal consequences of their actions, unsuspecting road users can have their lives cut short. Indeed, according to a recent report on traffic safety statistics released by the provincial Ministry of Transportation, 535 Ontarians were killed in car accidents in just one year.

Surviving a severe car accident can seem like a miraculous stroke of luck. However, many car accident victims sustain a range of injuries that can vary in severity. The negligence of other drivers can cause innocent community members to sustain catastrophic injuries. These injured car accident survivors often live with the devastating outcomes of their collision for the rest of their lives. A mother on her way to pick up her kids from school, a labourer heading home after work, a teenager driving to visit their friends, all of these regular members of the local community could lose their mobility, their senses, and their abilities to live independently, all because another driver failed to take the safety of others into consideration.

Even mild or moderately severe accident-related injuries can have huge impacts on a car accident victim’s overall quality of life. This is especially true for car accident survivors whose injuries make it impossible for them to continue carrying out the tasks associated with their jobs.

Some injuries that are commonly sustained in Sudbury car accidents include:

  • Whiplash
  • Soft tissue injuries
  • Broken or fractured bones
  • Cuts and lacerations
  • Strains and sprains
  • Musculoskeletal injuries
  • Facial and dental injuries
  • Internal organ damage
  • Neck and back injuries
  • Spinal cord injuries
  • Paralysis
  • Concussions
  • Traumatic brain injuries
  • Amputations
  • And more

No matter how severe your injury, our Sudbury car accident lawyers believe that you should not be forced to pay the high costs you have incurred because of someone else’s negligence. car accident FAQs

Here are some commonly asked questions for car accident claims

Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.

If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.

Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.

The amount of income replacement benefits you can receive will depend on your pre-accident income, but typically these benefits can cover up to 70% of your gross income before the accident, up to a maximum of $400 per week. If you pursue a civil claim against the at-fault driver whose negligence caused your collision, you may be able to recover 100% of your gross income loss and earning capacity after the trial.
