Students on their way to campus, office employees commuting to work, parents picking their kids up from school, and countless other Waterloo residents can have their lives changed in an instant when they encounter a negligent driver. Because of a stranger’s distraction, reckless, inebriation, or other form of wrongful conduct, families can be torn apart, futures can be destroyed, and substantial financial losses can be incurred as the result of violent, senseless, and ultimately preventable car accidents.

Preszler Injury Lawyers: Car Accident Lawyers In Waterloo

Although everyone expects other motor vehicle operators to exercise caution, patience, courteousness, and consideration for the safety of others, many drivers throughout the province operate their vehicles in a negligent fashion. Unfortunately, bad habits behind the wheel have become so commonplace that the number of fatalities resulting from Ontario car accidents recently reached a provincial high.

Driver distraction has become an increasingly pervasive and deadly problem. Nearly half of all Canadians admit to sending messages on their phones while driving. When a cell phone steals a driver’s attention away from the road, the consequences can be disastrous. In fact, distracted driving has surpassed inebriated driving as the leading cause of fatal car accidents in Ontario.

In accordance with the Ontario Highway Traffic Act, motorists have a duty of care to other road users. Failing to fulfill this duty of care by violating the rules of the road could be considered negligence. Common examples of negligence that frequently lead to fatal or injurious accidents in the Waterloo area include:

  • Texting while driving
  • Impaired driving
  • Distracted driving
  • Speeding
  • Ignoring traffic signs/signals
  • Improperly changing lanes
  • And more

If a driver’s negligence leads to a car accident in which another party sustains injuries, the at-fault motorist might be responsible for compensating injured accident victims for costs derived from their injuries. That is why, if you sustained injuries because of the wrongful actions of a negligent driver, our Waterloo car accident lawyers may be able to help you recover the compensation you deserve.

Depending on the severity of the injuries you have sustained and the impact they have had on your overall quality of life, our car accident lawyers serving Waterloo may be able to help you recover damages including:

  • Medical expenses
  • Attendant care
  • Pain and suffering
  • Physiotherapy
  • Mobility aids, assistive medical equipment
  • Prescriptions
  • Home modifications to accommodate newly acquired disabilities
  • Ambulance services
  • Mileage expenses to and from medical appointments
  • Housekeeping services
  • Psychological counseling
  • Lost wages due to missed work
  • Reduced future earning capability
  • And possibly more

All drivers in the province are required, by law, to obey local traffic laws and exercise caution on the province’s roads and highways. If you were injured in an accident caused by a negligent driver who violated the rules of the road, our Waterloo car accident lawyers may be able to fight on your behalf to help you recover the compensation you are owed. car accident FAQs

Here are some commonly asked questions for car accident claims

Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.

If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.

Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.

The amount of income replacement benefits you can receive will depend on your pre-accident income, but typically these benefits can cover up to 70% of your gross income before the accident, up to a maximum of $400 per week. If you pursue a civil claim against the at-fault driver whose negligence caused your collision, you may be able to recover 100% of your gross income loss and earning capacity after the trial.
