Car accidents in Barrie happen in many ways. A routine commute on Highway 400 to the GTA, a quick drive along Bayfield Street to the shops, or a trip down Mapleview Drive West toward the south-end retail area can be disrupted in an instant by a negligent driver. Winter storms off Lake Simcoe, heavy weekend traffic heading to cottage country, and busy intersections in the city all increase the risk of serious collisions.

If you were injured in a motor vehicle collision, consulting with a car accident lawyer serving Barrie could be critical. If your crash was caused by another driver’s wrongful actions, inactions, errors, omissions, or other form of negligence, our Barrie car accident lawyers may be able to help you pursue a civil claim against the at-fault driver.

To learn more about how our Barrie personal injury lawyers may be able to assist you, call 1-888-608-2111 and take advantage of a free, no-obligation initial consultation with our legal team.

How Car Accidents Happen in Barrie

Drivers who operate their vehicles in an unsafe manner that violates local traffic laws can cause fatal car accidents. In fact, recently, country-wide rates of collision-related fatalities reached an all-time high. Due to recklessness, inattention, impatience, inebriation, or other wrongful behaviour behind the wheel, negligent drivers can rob families of their loved ones and cause life-changing injuries to survivors.

Depending on the force of impact, vehicle type, and road conditions, people involved in car accidents around Barrie may suffer a wide range of injuries.

Injuries often seen in car accident cases include:

  • Whiplash
  • Soft tissue injuries
  • Broken or fractured bones
  • Cuts and lacerations
  • Strains and sprains
  • Musculoskeletal injuries
  • Facial and dental injuries
  • Internal organ damage
  • Neck and back injuries
  • Spinal cord injuries
  • Paralysis
  • Concussions
  • Traumatic brain injuries
  • Amputations
  • Psychological injuries
  • And more

These injuries can require surgeries, hospital stays, imaging and diagnostic tests, physiotherapy, occupational therapy, and other long-term rehabilitation services in Barrie and beyond.

Accident Benefits After a Barrie Car Accident

In accordance with Ontario’s Compulsory Automobile Insurance Act, all drivers in Ontario must purchase basic auto insurance to operate a vehicle. All automobile insurance plans throughout the province provide policyholders with the mandatory coverage outlined in the Statutory Accident Benefits Schedule.

As such, anyone who is injured in a car accident – regardless of their level of culpability – should be able to receive no-fault Statutory Accident Benefits. These benefits can provide compensation for certain injury-related expenses that are not covered by another health insurance plan. For example:

  • Medical expenses
  • Ambulance bills
  • Medical equipment
  • Prescriptions
  • Mobility aids
  • Physiotherapy
  • Chiropractic sessions
  • Massage therapy
  • Strength-training exercise programs
  • Psychological counseling
  • Home modifications to accommodate acquired disabilities
  • Mileage expenses for trips to and from medical appointments
  • And possibly more

Unfortunately, depending on the severity of injuries sustained by car accident victims, the accident benefits to which they are entitled may not sufficiently cover their total financial losses.

Injured car accident victims frequently incur substantial economic losses. This is especially true for accident victims whose injuries prevent them from returning to work and earning their regular wages. In such cases, survivors may need to explore additional forms of compensation, such as lawsuit damages or long-term disability benefits in Barrie.

Suing a Negligent Driver After a Collision in Barrie

In some cases, accident benefits may not be enough to cover the full impact of a serious collision. If another driver’s negligence caused your injuries, you may be entitled to bring a separate lawsuit, often called a tort claim, for additional compensation.

Through a civil claim, our Barrie car accident lawyers may seek damages for:

  • Pain and suffering
  • Loss of enjoyment of life
  • Loss of income and earning capacity
  • Out-of-pocket medical and rehabilitation expenses
  • Future care costs
  • And possibly more

The value of your claim will depend on factors such as the severity and duration of your injuries, your age and occupation, and the effect of the collision on your life in Barrie or Simcoe County.

Car accident claims are subject to complex rules about thresholds and deductibles for pain and suffering, as well as limitation periods that are often two years from the date of the accident under the Limitations Act. There can also be shorter timelines for certain notices and claims.

car accident FAQs

Here are some commonly asked questions for car accident claims

Yes. Even when fault seems obvious, insurers often argue about liability or damages. A lawyer ensures your rights are protected.

Ontario uses a system called contributory negligence. If you share blame, your damages may be reduced by your percentage of fault.

Preszler Injury Lawyers works on a contingency fee basis. You don’t pay upfront legal fees. Instead, payment is based on the outcome of your claim.

The Motor Vehicle Accident Claims Fund provides a safety net in these situations. Our team can help you pursue this option.

Yes. Passengers have the same rights to accident benefits as drivers. You may also pursue a tort claim against the responsible driver.

Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.

If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.

Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.
