When a serious illness, injury, or mental health condition makes it impossible to keep working, long-term disability (LTD) benefits can become a financial lifeline. In Ajax and across the Durham Region, many people have LTD coverage through their employer. Others purchase individual disability policies because they are self-employed, work on contract, or want additional protection.

LTD benefits typically replace a portion of your income when you can no longer perform the essential duties of your job. For residents who commute along Highway 2 or Highway 401, work in local logistics hubs, or hold jobs in offices and retail centres throughout Ajax, these benefits can help cover everyday costs while they focus on treatment and recovery.

At Preszler Injury Lawyers, our long-term disability lawyers serving Ajax have years of experience helping clients address denied, delayed, or terminated LTD benefits. In collaboration with our Ajax personal injury lawyers, we can challenge unfair insurer decisions to ensure you have access to the benefits you need. Schedule a free consultation today to find out if you’re eligible to file a claim against your insurance company.

Medical Conditions That May Qualify For LTD Benefits in Ajax, Ontario

Each LTD policy has its own wording, but many recognize a broad range of physical and mental health conditions. Chronic pain, serious back and neck problems, cardiac issues, autoimmune diseases, neurological conditions, depression, anxiety, bipolar disorder, and post-traumatic stress disorder are all examples of conditions that can be disabling, especially when symptoms are persistent and resistant to treatment.

Initially, policies often focus on whether you can perform the “own occupation” you were working in when you became disabled. After a period of time, usually around two years, the test may change to determine whether you can perform “any occupation” for which you are reasonably suited by education, training, or experience. This shift can lead insurers to terminate benefits even when your underlying health has not improved.

Our Ajax LTD team can review your policy and medical information to help determine whether your condition appears to meet the applicable definition of disability.

Why Ajax LTD Claims Are Denied Or Cut Off

Unfortunately, many LTD claims submitted by people who live or work in Ajax are not approved at all, or are paid for a period and then stopped. Insurance companies are not required to publish their denial statistics, but rates across Ontario suggest that a significant number of claimants face denials or premature terminations.

Insurers may say there is not enough “objective” evidence, rely heavily on a doctor they hired to examine you once, or argue that you could perform some other job that does not realistically exist in the Ajax labour market. They may also point to social media posts or surveillance footage and claim it does not match your reported limitations.

Receiving a denial letter can be overwhelming, especially when you are already juggling medical appointments at Ajax Pickering Hospital, counselling sessions, or rehabilitation programs. Our long-term disability lawyers serving Ajax can help you understand the insurer’s reasoning and identify possible ways to challenge the decision.

By working with our Ajax long-term disability lawyers, you may be able to challenge a denial or cut-off of your LTD benefits. At our firm, we can:

  • Review your medical records and, where appropriate, help coordinate additional assessments to clarify your functional limitations
  • Work with your doctors and treatment providers in Ajax and across Durham Region to obtain detailed reports that address the insurer’s concerns
  • Communicate with the insurance company on your behalf and negotiate for a fair resolution
  • Start a lawsuit if negotiations do not lead to a reasonable outcome
  • And more

Many people who need LTD benefits also have other claims. If your disability stems from a serious car accident or a fall on unsafe premises, our Ajax car accident lawyers and Ajax slip and fall lawyers can work alongside the LTD team to consider how all of your claims might interact.

long-term disability FAQs

Here are some commonly asked questions for long-term disability claims

Yes, CPP denials can be appealed through the Social Security Tribunal, which reviews applications and medical evidence.

You may seek a second opinion from another qualified physician to provide additional evidence.

Insurers may stop benefits if they believe you no longer meet the disability definition, but they must provide reasons.

Employers usually only know that you’re receiving LTD benefits, not the details of your medical condition.

Your LTD insurer may deduct CPP benefits from your LTD payments. Approval for CPP Disability may strengthen your LTD case.

Sometimes, policies allow partial benefits if you can work reduced hours. The rules depend on your policy language.

Taxation depends on whether your premiums were paid with pre-tax or after-tax income. If your employer paid the premiums, your benefits may be taxable.

Employment termination doesn’t automatically cancel your LTD benefits. Your coverage may continue as long as you were covered when you became disabled.
