In a flash, car accidents can change the course of people’s entire lives. Because of the negligence of another driver, unsuspecting motorists, their passengers, and other road users could endure decades of pain, discomfort, grief, and financial insecurity.

In recent years, the number of Ontarians killed in car accidents has reached an all-time high. When a negligent driver glances away from the road to check a cell phone notification, coasts through an intersection while ignoring traffic signals, gets behind the wheel while inebriated, or engages in any other form of negligence, families in the community can be separated in senseless, violent, preventable car accidents.

At Preszler Injury Lawyers, our Courtice car accident lawyers are committed to helping victims of motor vehicle accidents pursue the compensation they deserve for their injuries. To find out if you’re eligible to file a claim, call 1-888-608-2111 or contact us online now.

Common Injuries Sustained in Courtice Car Accidents

People who survive traumatic car accidents often suffer a range of injuries, to varying degrees of severity. These may include:

  • Whiplash
  • Soft tissue injuries
  • Broken or fractured bones
  • Cuts and lacerations
  • Strains and sprains
  • Musculoskeletal injuries
  • Facial and dental injuries
  • Internal organ damage
  • Neck and back injuries
  • Spinal cord injuries
  • Paralysis
  • Concussions
  • Traumatic brain injuries
  • Amputations
  • And more

Many of the injuries sustained in car accidents require long periods of hospitalization, difficult rehabilitation therapies, drastic lifestyle adjustments, and significant expense. Even injuries that are widely considered to be “moderately” severe can impact a survivor’s ability to perform the duties of their job or participate in the same activities they enjoyed before their collision.

The inability to return to work in a chosen occupation often makes it difficult for car accident survivors to continue supporting themselves and their family members. In addition to navigating accident benefits claims and a potential tort claim, victims may also need to navigate the complexity of a Courtice long-term disability claim.

Proving Liability and Negligence Under the Highway Traffic Act

To successfully recover damages in a civil claim, it must be demonstrated that the other party’s negligence caused the accident. In Ontario, all drivers are expected to adhere to the rules set out in the Highway Traffic Act. When a driver violates these laws (whether by speeding, following too closely, or failing to yield) they have breached the duty of care they owe to others on the road.

Our Courtice car accident lawyers work diligently to gather evidence, such as police reports, witness statements, and surveillance footage, to establish liability. If you are eligible to pursue a civil claim against a negligent motorist, you might be able to recover significant injury-related damages that have been incurred as a result of their misconduct.

Statutory Accident Benefits and Tort Claims in Ontario

Victims of car accidents in Ontario generally have two potential avenues for financial recovery. The first is through Statutory Accident Benefits (SABS), which are available to almost anyone injured in a motor vehicle accident, regardless of who was at fault. These accident benefits can provide immediate assistance with medical expenses and lost income.

The second avenue is a tort claim, which is a lawsuit filed against the at-fault driver. Depending on the severity of your injuries and how they have impacted your life, the damages you seek can be both economic and non-economic in nature. While accident benefits provide a baseline of support, a tort claim allows victims to pursue compensation for losses that exceed the limits of their insurance policy, particularly in cases of catastrophic impairment.

Potential Damages and Financial Compensation

Many of the injuries sustained in car accidents require long periods of hospitalization, difficult rehabilitation therapies, and drastic lifestyle adjustments. Even injuries that are considered moderately severe can hinder a survivor’s ability to perform their job or enjoy the hobbies they loved before the collision. The inability to return to work often makes it difficult for injured survivors to support themselves and their families.

By working with our Courtice car accident lawyers, you may be able to recover compensation for various economic and non-economic losses, including:

  • Current and future medical expenses and prescriptions.
  • Attendant care and housekeeping services.
  • Pain and suffering and loss of enjoyment of life.
  • Physiotherapy, mobility aids, and assistive medical equipment.
  • Home modifications to accommodate newly acquired disabilities.
  • Ambulance services and mileage for medical appointments.
  • Psychological counselling to address trauma.
  • Lost wages and the reduction of future earning capability.
  • And possibly more.

Strict Deadlines for Filing a Car Accident Claim in Courtice

It is vital to understand that your time to take legal action is not unlimited. According to the Limitations Act, 2002, most personal injury lawsuits in Ontario must be commenced within two years of the date of the accident.

However, other much shorter deadlines apply to the insurance claims process. For instance, you must typically notify your own insurance provider within seven days of the accident and submit an application for benefits within thirty days of receiving the forms. Delaying these steps can jeopardize your ability to receive the financial support you need.

Consulting with a Courtice personal injury lawyer early in the process ensures that all procedural requirements are met and your rights are protected.

car accident FAQs

Here are some commonly asked questions for car accident claims

Yes. Even when fault seems obvious, insurers often argue about liability or damages. A lawyer ensures your rights are protected.

Ontario uses a system called contributory negligence. If you share blame, your damages may be reduced by your percentage of fault.

Preszler Injury Lawyers works on a contingency fee basis. You don’t pay upfront legal fees. Instead, payment is based on the outcome of your claim.

The Motor Vehicle Accident Claims Fund provides a safety net in these situations. Our team can help you pursue this option.

Yes. Passengers have the same rights to accident benefits as drivers. You may also pursue a tort claim against the responsible driver.

Loss of income benefits are typically paid to injured victims of motor vehicle accidents once their claim has been approved by their auto insurance provider. To receive these benefits, you may be required to provide your insurer with documentation from your employer, physicians, and other medical experts stating that your injuries prevent you from working. You will not be granted loss of income benefits for any wages lost during the first 7 days after the injury-causing collision, however you may be eligible to claim lost income for missed working days after that time limitation has elapsed.

If your injuries meet the threshold of catastrophic impairment, you may be entitled to additional benefits such as increased medical and rehabilitation benefits, attendant care benefits, and housekeeping and home maintenance benefits.

Close family members of a person who has been injured or killed in a motor vehicle accident may be able to sue the at-fault driver for their own losses such as loss of care, guidance, and companionship.
